Guidance On Repairs To Council Owned Shops And Factories

South Tyneside Council owns and manages 220 shop premises within 37 shopping estates and 170 factory units within 14 industrial estates.

In respect of each property a written agreement is in place which sets out the responsibilities of each party.

Responsibilities
The legal agreement sets out the responsibilities for items about rent, term of occupancy, use of the premises, statutory requirements, insurance, etc. and which of the parties is responsible for the repairing requirements. Each legal agreement may differ but normally the Council is responsible for the main structure of the premises ( roof, walls and floor ) and the tenant is responsible for the maintenance and repair of the following :

  1. Electrical installation
  2. Fire alarm and emergency installation
  3. Gas installation including all appliances and pipe work from the gas meter
  4. Windows including frames and glazing to both the inside and outside
  5. Floor finishes including vinyl floor coverings, carpets or the painted finish to the concrete floor.
  6. Decoration to the premises including ceiling and wall and floor where appropriate.
  7. Doors including locks
  8. Roller shutters.
  9. Others as appropriate

It is to be noted that each tenant has a legal responsibility regarding the testing and servicing of the premises equipment, most of which is listed above. You are required to appoint competent and suitably qualified contractors to ensure you are complying with your legal requirements.

Repairs to property
Repairs can be classed as urgent or non- urgent. You should assess whether the repair is of an urgent nature. To provide assistance on this you can view the urgent repairs procedure online .

Non-urgent repairs are considered to be repairs which do not immediately affect the health and safety of the tenant, occupant or others.

Repairs will be carried out within certain timescales dependant on the classification of the repair. See below for timescale for attendance to an emergency repair. Non- emergency repairs will be placed within two weeks following the request of the repair.

Crime

In order to help the Council and the Police reduce crime each tenant is asked to report a crime related incident whether this be a break in, attempt break in, vandalism or youth disorder to Asset Management

You should also report all incidents to the police and obtain a crime number.

Asset Management is developing a crime strategy linked to the Councils Community Safety Section. We record all crime related incidents to the Council owned property and form a strategy based on the crime data.

Performance management

The Asset Management Section is required by the Government to record data as part of Best Value. These recorded data are known as Performance Indicators and are used to compare the Councils performance against other Local Authorities and the Private sector.

The Council also collects data specific to the Councils main aims which are . Each repair job when requested is recorded and its time, cost and performance is monitored. Crime incidents are recorded whether they are break ins , vandalism and arson with each years results analysed and compared to the previous years.

Our aim is to constantly strive to improve the service which the Council provides. This is reviewed on an annual basis . Figures of our performance are published and are available for viewing
